As we reported in the April 18 Benefits Byte, the U.S. Supreme Court issued a confounding and unfortunate unanimous opinion in Cunningham v. Cornell University, an important case testing the standards for bringing a lawsuit against a plan sponsor under ERISA.
The American Benefits Council strongly disagrees with the decision and the high court's rationale for it, and remains concerned that it could lead to increased litigation and higher costs for plan sponsors.
